For overseas Pakistanis, property transactions are often the most significant financial and legal undertakings they face. The process is governed primarily by the Registration Act of 1908 and the Transfer of Property Act of 1882.
It is essential to distinguish between the two primary phases of property transfer: the "Registry" (formal registration of the Sale Deed) and the "Mutation" (Intiqal) — the administrative process of updating government land records.
The "Registry" refers to the formal execution and registration of a Sale Deed. This document is the principal legal instrument for property transfer and must be drafted with absolute precision. Any error in names, CNIC numbers, or plot boundaries can lead to protracted legal disputes.
A common misconception among British Pakistanis is that obtaining the registered Sale Deed completes the transfer. While the Sale Deed is legal proof of the transaction, the "Intiqal" or Mutation is the administrative process of updating the government's land records (the Jamabandi) to reflect the new owner's name.
Without mutation, the previous owner's name remains in the revenue records, enabling potential fraud or the inadvertent inclusion of the land in the previous owner's inheritance proceedings. The Registry is a contract — Mutation is the government's recognition of that contract.
