Understanding Court Jurisdiction

When property transactions fail or illegal occupation occurs, the legal remedy depends on the nature of the dispute and the character of the property. Pakistan's judicial system divides land-related matters between Revenue Courts and Civil Courts, a distinction that is frequently misunderstood.

The West Pakistan Land Revenue Act of 1967 bars the jurisdiction of civil courts in matters that revenue officials are specifically empowered to resolve. This exclusion ensures that agricultural and revenue matters are handled by specialists in the land record system.

Revenue Courts

Administrative offices of the Tehsildar, Collector, and Commissioner acting in a judicial capacity.

Special Courts for Overseas Pakistanis (2024-2025)

Recognizing that nearly 40% of overseas Pakistanis face property-related challenges, the government enacted the "Establishment of Special Courts (Overseas Pakistanis Property) Act, 2024". This legislation addresses the "immense emotional and financial toll" caused by illegal occupation and slow traditional litigation.

These Special Courts, initially established in Islamabad and extended to Punjab through the 2025 provincial act, represent a significant departure from the standard civil system where cases can linger for years. To utilize these courts, applicants must provide proof of overseas Pakistani status via NICOP or POC.

Land Grabbing (Qabza) Protection

The term "Qabza" refers to unauthorized and often forceful occupation of land. For British Pakistanis whose properties remain vacant for long periods, the "Qabza Mafia" represents a persistent threat.

Section 9 - Specific Relief Act 1877

Allows an illegally dispossessed person to recover possession through a summary suit, provided they file within six months of the dispossession. This is the swiftest legal remedy against land grabbing.
